Don’t pay less than minimum wage

Don’t make so many deductions that the final paycheck amount is so low that it makes the ex-employee earn less than minimum wage for the timeframe. Complicating the matter is that the calculation is based on applying the deductions to only the first forty hours of work in a week. You generally can’t include overtime hours in the calculation.
Don’t delay the payment

It’s usually okay for an employer to sue your company if their last paycheck is delayed for longer than 30 days. In most states, it is recommended that the last paycheck be distributed according to the normal paycheck cycle.
Don’t ignore state-level laws

Many times, state laws can affect your decisions about what is included in the last paycheck.

Issue quickly

Many times, the last paycheck is associated with a termination or an employee quitting. In either case, tensions can be high and misunderstandings are easy to create. It’s usually best to just cut that last paycheck and get that out of the way, rather than delaying and creating the appearance of “punishing” the former employee. In lawsuits, it’s common practice to assume a jury wants to see that the company acted in a fair manner. Any unnecessary burdens you place on an ex-employee can be a detriment if a lawsuit arises out of the situation.
Keep in mind the deductions applicable

When cutting that last paycheck, try to make sure you are using a legal and appropriate methodology when applied to cashing out saved-up vacation and sick time. Also pay attention to the different levels of law that can affect the paycheck calculation.

      <title>Workers’ Compensation fraud lands couple in jail.</title>

      <description><![CDATA[A California couple that owned three roofing contractor businesses were arrested in 2010 for fraud. Recently, they were ordered to pay over $2,8 million in restitution. 
In 2006 one of their employees fell from a roof and submitted a payroll stub to California’s State Fund Compensation Insurance. After realizing they did not insure the company indicated on the stub, SCIF notified the authorities.
During the investigation, it was revelaed that the couple, Devon Lynn Kile and Michael Vincent Petronella, submitted 42 claims that turned out to be fraudulent. In addition, they underreported over $10 million in payroll expenses to avoid paying workers’ compensation insurance premiums. This totaled to over $30 million in workers comp insurance premium fraud.

      <description><![CDATA[In October, the health care industry experienced minor job creation—adding only about 11,600 positions. The overall unemployment rate in the U.S. was 9 percent. 
Based on statistics from the U.S. Bureau of Labor Statistics, health care jobs held steady at 14.2 million, with an increase of only 0.1 percent. In September, the Bureau reported the overall U.S. unemployment rate at 9.1 percent. According to seasonally adjusted numbers, health care added an average of 27,957 jobs per month during the previous 12 months (ending in October). During that time, the industry added 367,500 jobs. Back in October 2010, there was a 2.7 percent increase.
According to the Bureau of Labor Statistics, outpatient care centers saw the biggest rise, increasing close to .5 percent with 2,900 new positions. Two proposals that could take effect in 2012 threaten the financial benefits of the 401(k) program and affect how much employees can place into their accounts. Currently the 401(k) system and the IRA rollovers that occur from them are some of the largest sources of retirement financing in the country.
One proposal is from 2010 and one is more recent.

      <description><![CDATA[Either by mistake, or to avoid paying overtime to employees, many companies incorrectly classify nonexempt works as exempt. The normal rule is to pay nonexempt employees overtime for work in excess of 40 hours per week.

So, if you’re going to classify an employee as exempt, take the following into consideration:

To avoid penalties, the exempt employee generally has to be paid on a salary basis and receive a minimum salary. That means a preset amount each pay period. And, you can’t reduce the amount because of a change in the quantity or quality of the employees work. In addition, if your employee performs ANY work during a week, they usually must be paid for that entire week.

If your exempt employee performs some hourly-paid work, that may break their entire exempt status. If that is the case, you may owe overtime on all work in excess of 40 hours per week.

      <description><![CDATA[According to a new study by MassMutual, women are more concerned than men about keeping up with monthly expenses. The study found both men and women are worried about saving enough money for retirement. In addition, more than twice as many women are concerned about monthly expenses over saving enough for retirement down the road. 
The nationwide survey was conducted with American workers who are eligible to take part in employer-sponsored defined contribution retirement plans. The study was sponsored by MassMutual retirement Services and done by Brightwork Partners. 
According to data from the survey, 31 percent of respondents think the United States will remain in a recession for the next 12 months. In addition, 38 percent are “somewhat” or “very concerned” about losing their jobs. The largest financial worry is “just keeping up with monthly expenses” (at 21 percent), followed by “saving enough for retirement” (at 18 percent).

      <description><![CDATA[A former press box hostess for the Indianapolis Colts is accusing the National Football League (NFL) of underpaying her and “a dozen or more” of her co-workers. According to the class-action lawsuit that was filed last month in federal district court in Indianapolis, hours worked were not documented. 
Per the court documents, Colleen Fenstermaker is seeking class-action status that would include other unnamed hostesses, in part because “some, if not most, of the individual group members may not be aware of their rights to wages under federal and Indiana law, or may not, because of financial means or experience, be in a position to seek the assistance of counsel to commence individual litigation.”

      <description><![CDATA[Ford Motor Co. recently said it will add or retain 12,000 jobs in the United States as part of its $16 billion in planned investments under a new labor agreement with the United Auto Workers (UAW). The 12,000 number includes 5,000 positions that were already announced. The automaker plans to in-source manufacturing work from China, Japan and Mexico. 
Ford and the UAW came to a tentative agreement last month covering benefits and wages for 41,000 employees. Market analysts expect the Ford agreement to be comparable to an earlier one with General Motors. 
Ford went into the talks looking to decrease its labor costs (which are the highest in the industry). They are also hoping to gain more equality with Chrysler Group and GM. According to the Center for Automotive Research in Ann Arbor, Michigan, Ford’s hourly labor costs (including wages and benefits) averaged $58 in 2010.       <description><![CDATA[The Internal Revenue Service (IRS) says due to inflation, for tax year 2012, personal exemptions and standard deductions will increase and tax brackets will broaden. 
By law, the dollar amounts for many tax provisions (which impact just about every taxpayer), must be revised each year in order to keep up with inflation. According to the IRS, new dollar amounts that will impact 2012 returns (filed by most people in early 2013), will include the following:

    The value of each personal and dependent exemption available to most taxpayers is $3,800. This is a $100 increase from 2011. 
    The new standard deduction for married couples filing a joint return is $11,900 (which represents a $300 increase from 2011), for singles and married individuals filing separately is $5,950 (up $150 from 2011) and for heads of household is $8,700 (up $200 from 2011).       <description><![CDATA[Notice 2011-72, issued from the IRS in September, in tandem with a Memorandum for All Field Examination Operations.

The effect helps to simplify the rules regarding what is taxable and what isn’t regarding cell phones that you allow employees to use.

The new guidance states that as long as the cell phone use is “primarily for noncompensatory business reasons”, the cost of the phones and their service should not be treated as employee income. Rather, all the expenses should be treated as business expenses. So, if you let employees use company cell phones "primarily for noncompensatory business reasons," then there you don’t have to track or substantiate the calls anymore – the entire use of the phone is non‐taxable to the employee. This mean it doesn’t show on their W-2. As the employer, your company can take the full deduction for the cost of the cell phone (and related data plans).

In states like Kansas, Montana and Oklahoma, much progress has been made. Recent measures focused on tightening eligibility for workers’ compensation disability benefits, as well as limiting an employer’s obligation to pay for medical treatment of workers who are injured. 
It’s expected that costs could be cut by more than 20 percent the first year in Montana, which has the highest workers’ compensation rates in the United States.       <description><![CDATA[Extending the payroll tax cut is a tough sell since the 2011 benefit was unproven. Economic experts say the results of this year’s payroll tax cuts were limited because much of the extra money that workers took home went to cover increasing gas prices (which reached a three-year high in May), instead of personal spending. In President Barack Obama’s $447 billion jobs plan, the most expensive part of it is expanding and extending a decrease in the payroll tax that funds Social Security. Some economists say allowing the payroll cut to expire at the end of this year would slow down economic growth for next year. 
The goal of the payroll tax cut is to give American workers more money, while encouraging consumer spending and thus stimulating the economy. Economists say it’s impossible to know what would have happened without the payroll tax cut.

      <description><![CDATA[The U.S. Postal Service continues to be desperate to find ways to cut money from its payroll. As a result, they are considering shutting down more than half of its mail processing centers nationwide. This would impact businesses across the United States. If this happens, it would add a day to the time it takes to deliver many first-class letters. The agency lost $8.5 billion last year and recently told Congress it could not make a $5.5 billion payment to a federal retiree health care trust fund. 

The Postal Service does not need approval from Congress to close the centers. Postmaster General Patrick Donahoe says that next year, the Postal Service will also seek to increase the price of mailing a first-class letter (which now costs 44 cents). Postmaster Donahoe says that by shutting down post offices and stopping the delivery of mail on Saturdays, such changes could save $3 billion a year in labor costs.

      <description><![CDATA[According to the U.S. Department of Labor, companies nationwide increased hiring last month. However, the pace was sluggish as the economy is still in low gear. Close to 103,000 new jobs were created, which was more than experts had originally predicted. However, that did not impact the unemployment rate for September, which remained unchanged at 9.1 percent for the third straight month. The Labor Department also recently stated that in both July and August, job growth was higher than it had previously estimated. 
Though there are some rays of sunlight, economic forecasters say there is a long way to go as only 100,000 jobs a month have been created since this past spring. That is below the estimated 125,000 that are needed every month to keep up with our growing population. There are currently about 14 million Americans who are unemployed.

According to the U.S. Bureau of Labor Statistics, 25 percent of people report working 41 or more hours a week. Due to workers being laid off, hiring freezes and businesses that want to grow, companies are assigning workers with more responsibilities. While the overworked employees feel grateful to have a job, workplace experts say this could cause employees to eventually get frustrated.

      <description><![CDATA[New research shows technology executives expect information technology (IT) hiring to continue in the fourth quarter of this year. According to a recent survey by Robert Half Technology IT Hiring Index and Skills Report, 12 percent of chief information officers (CIO’s), say they plan to expand their IT departments this year. In addition, six percent expect cutbacks—for a net 6 percent projected increase in hiring activity. This is a two-point increase from the previous quarter’s projections.
Here are some additional key findings from the survey:
92 percent of CIO’s are confident in the growth prospects at their company over the next three months. This is up five points from last quarter.

      <description><![CDATA[The Internal Revenue Service (IRS) recently issued a notice to employers who outsource their payroll responsibilities to third-party service providers. In an e-mail about tax tips, the IRS informed people about recent prosecutions of companies and individuals who pretended to be a payroll service provider—but were actually thieves who took funds that were meant for payment of employment taxes. The IRS wants to remind people that the employer is ultimately responsible for depositing and paying federal tax liabilities.
In the e-mail, the IRS cautioned, “Even though you forward the tax payments to the third party to make the tax deposits, you — the employer — are the responsible party. If the third party fails to make the federal tax payments, the IRS may assess penalties and interest. The employer is liable for all taxes, penalties and interest due.       <title>Survey Shows Average Pay Increases for Workers next year</title>

      <description><![CDATA[According to a new survey by global professional services company Towers Watson, U.S. companies are expecting moderate pay raises for workers next year in 2012. Seven hundred seventy three employers provided data for the survey. Since corporate profits have increased, employers report they expect to fund bonuses for employees this year.
For 2012, companies plan to give pay increases to salaried, non-executive employees that will average 2.8 percent. This number shows an increase over both 2010 and this year when workers received 2.6 percent increases. Comparable increases are planned for both executives and non-exempt employees for next year.
The survey also found that workers with high performance ratings could receive salary increases of up to 4.5 percent this year. This is 80 percent more than workers with only average ratings will get (at 2.5 percent). Employees with performance ratings that are below average will most likely receive increases of about 1.4 percent.

      <description><![CDATA[Even though many companies have cut payrolls in the past few years, it looks like severance packages may have remained intact. According to a new study recently released by WorldatWork and Innovative Compensation and Benefits Concepts LLC (ICBC), severance and change-in-control plans have actually made it through the recession in pretty good shape. 
Many companies still have a formal severance plan for the CEO, and then one for key executives and one for everyone else. Determining factors of severance status include years of service, pay level, position and employment agreements. 
The survey found that companies are reviewing severance and change-in-control plans less frequently than in years past. In addition, severance plans are still considered an important employee benefit and resource to help with job transition.

      <description><![CDATA[In the ongoing quest to make getting money to workers as easy as possible, Global Payout, Inc. will soon launch a major effort to provide payroll debit cards to companies in the United States. The company says the goals of the effort are to reduce costs for businesses and to improve efficiencies in payroll processing for employees. The company will soon begin a nationwide telemarketing campaign that will include phone calls to more than 12,000 companies in hospitality, construction, waste management, janitorial and employment services.
In a press release distributed by the company, Global Payout, Inc. Chief Executive Officer said, “Payroll debit cards have gone mainstream by catering to people who are underserved or un-banked. Nearly one in five Americans are un-banked and the number is growing. Our company is positioning itself for rapid growth based upon the estimated amount of money loaded onto prepaid cards that will reach $552 billion in 2012 from $330 billion three years earlier.”
